Terms & Conditions 

Background

These terms and conditions make up a legally binding agreement (the Agreement) between Zadig Studio ABN 54 659 674 209 (referred to in these terms as “Us”, “We” and “Our”) and you.

This Agreement may be accepted by purchasing and making payment for our services through our website www.zadigstudio.com.au or when booking a session by phone or in person.

THE PARTIES AGREE as follows:

1. Payment and Refunds

1.1 Single Sauna Sessions

(a) You will be required to provide credit card details when booking with Us online. Payment for your session will be made on the day of your session.

(b) Payment for your session will be required prior to your session and can be made through our website, Fresha or on arrival for your session.

(c) You acknowledge and agree that there are no refunds for change of mind. You may reschedule any session with Us by providing more than 4 hours’ notice.

1.2 Sauna Packages

(a) You will be required to provide credit card details when booking with Us and you will be billed for your sauna package based on the package purchased. Please refer to the payment details on the pricing section of Our website.

(b) Payment for your session will be required prior to your session and can be made through our website, Fresha or on in person at our studio.

(c) You acknowledge and agree that there are no refunds for change of mind if you select any of Our sauna or sweat packages.

2. Arriving for your session

2.1 When arriving for your session:

(a) please arrive at least 5 minutes prior to your session.

(b) please check in with our reception and finalise any payment for your session.

2.2 We do not provide secure lockers at our studio and will not be liable for loss or damage to your personal belongings. You agree that you bring your personal belongings to our studio at your own risk.

3. Cancellations

3.1 If you have purchased a single sauna session, you acknowledge and agree that:

(a) a minimum 4 hours is required to cancel or reschedule your session. All cancellations must be done through phone or Fresha;

(b) if your session is cancelled or rescheduled within 4 hours, 50% of the fee will be deducted from your credit card;

(c) if you do not show up for your scheduled session or are more than 15 minutes late, 100% of the fee will be deducted from your credit card.

4. Who should not use our Saunas?

4.1 You agree that your use of our studio is at your own risk.

4.2 Please always seek professional medical advice before using our saunas or if you;

• Are on any medications;

• Suffer from obesity;

• Suffer heart disease;

• Have low or high blood pressure;

• Have any chronic disease;

• Have any ongoing health issues;

• aged under 18 years or over 55 years of age.

4.3 You cannot use Our sauna if you are pregnant, have a fever, any chronic health condition, acute bleeding or are intoxicated.

4.4 By booking a sauna with Us, you acknowledge that you are not restricted from using our sauna based on any of the conditions under this clause.

4.5 Any of the services provided by Us should not substitute medical advice or treatments prescribed by a doctor.

4.6 Our studio is a welcoming environment for our staff and guests. We reserve the right to refuse entry to anyone who appears under the influence of drugs or alcohol, or anyone who behaves in an abusive, threatening, harassing manner to our guests or staff. If you are refused entry to Our studio under this clause, your payment for the session will not be refunded.

5. Limitation of Liability

5.1 Our aggregate liability to you for any Loss arising out of or in connection with:

(a) any act, error, negligence, misrepresentation or omission concerning or arising out of Our services; and

(b) any breach of the Agreement or breach of duty of any kind owed in connection with the provision of the services;

is limited to and will not in any circumstances exceed the price paid for any of Our services, as the case may be.

5.2 Nothing in this Agreement is intended to exclude or restrict any liability that cannot be excluded or restricted by law.

In this clause Loss means any and all loss (including pure financial loss), injury, liability, damage, compensation, claim, demand, expense, interest or cost, including reasonable legal fees, whether arising in tort, contract or otherwise (including costs awarded or incurred) of any kind.

6. Force majeure

6.1 We do not have any liability under or may be deemed to be in breach of this Agreement for any delays or failures in performance of this Agreement which result from circumstances beyond Our reasonable control.

6.2 If you have purchased a Sauna or Sweat packages and We are affected by circumstances outside of Our control, we will reschedule your sessions once we are able to provide the services.

6.3 If We are affected by these circumstances we will promptly notify you of any circumstances which will cause a delay or failure in performance and when they cease to do so.

7. Termination

7.1 We may terminate this Agreement by notice in writing to you, if you:

(a) fail to observe any term of this Agreement; or

(b) fail to rectify a breach, to Our satisfaction following the expiration of 7 days’ notice of the breach being given in writing to you.

7.2 Notwithstanding any other provision of this Agreement, We may terminate this Agreement for any reason by providing you with 2 days’ notice.

8. Applicable Law

8.1 The parties expressly agree that this Agreement will be governed by and interpreted in accordance with the laws of the State of New South Wales.
